Initials here:_______ This agreement constitutes a contract between the guest(s) and Black Pine Cabin Rental (Owners Roy and Suzanne McKinney). Guest acknowledges and understands that by signing this agreement, he/she states that he/she has read and understands the written policies provided at www.blackpinecabinrental.com and agrees with all statements there and herein.
1. Guest confirms that he/she is 21 years or older. (proof of age will be required at check in).
2. Property Damage: Guest(s) acknowledge and understand that he/she is financially responsible for any and all property damage that may occur during the stated rental period which can reasonably be attributed to the party’s negligence or abuse.
3. Guest Count: Guest(s) agree that the premises will be occupied by no more than the number of people paid for and stated herein. Maximum number of guests: _______ Occupancy is limited to registered guests only. Absolutely no overnight guests allowed. Day guests are allowed by permission only and are required to check in at office before going to cabin. Occupancy by more than the stated number of guests will result in the termination of the rental and the forfeiture of all rental fees and deposits.
4. Loss of Security Deposit: Guest(s) agree to follow all check-in and check out procedures, and understand that the property must be left clean and undamaged. Guest(s) understand that failure to follow the posted check-in and check-out procedures may result in the loss of all or part of the security deposit and that the owners reserves the right to further bill him or her for additional cleaning or repairs. (Guest(s) agree to read all of the documents provided at check-in, as well as those printed in the information book and/or posted policies provided in the cabin.)
5. Disputes: This agreement shall be governed by and interpreted in accordance with the laws of the State of Tennessee, an shall be treated as though it were executed in the county of Campbell, State of Tennessee. Any action relating to this agreement shall be instituted and prosecuted only in the Campbell County Superior court, Tennessee. Guest(s) specifically consent to such jurisdiction and to extraterritorial service of the process.
6. Checks: All checks for payment must be received prior to the stated arrival date. A $35.00 service charge will be incurred for all returned checks.
7. Check-in/Check-out Time: Guest(s) acknowledge and understand that check-in is no earlier than 3:00 PM and check-out time is no later than 11:00 AM on the dates stated in the rental period above. Guest(s) acknowledge that an unapproved late check- out will be assessed an amount equal to one-half the nightly rental fee for each 30 minute period past 11:00 AM.
8. No Firearms-No Fireworks- Yes ATVs: The occupancy and use of the premises shall not be such as to place the property in danger of damage or to disturb and/or offend area neighbors or residents. The owners reserve the right to terminate this agreement and request loud or unruly guest to vacate the premises immediately. Said discharge shall not result the refund of any rental fees. ATVs are allowed in tow or on the lane only! Absolutely no riding ATVs off the lane , a $25.00 fine will be imposed.
9. Early Departure Arrival Policy: No refunds will be made for early departures or delayed arrivals. No refunds or schedule changes will be made due to inclement weather.
10. NO PETS: If a pet belonging to any member of the rental party, or guest of the rental party, is found to be in or on the premises, guest will be removed from the property and agrees that the full rental fee and deposit will be forfeited and acknowledges that any damage done by said pet shall be his/her financial responsibility.
11. NO SMOKING: This is a non-Smoking Cabin. If it is found that any member of the rental party, or guest of the rental party, has smoked inside the cabin, your entire security deposit will be forfeited. The entire cabin is designated as a non smoking area. Guests may, however, smoke in the outside deck area. Cigarette butts must not be disposed of in the yard or anywhere on the property.
12. Wild Life: Our Cabins are located in the Cumberland Mountains of east Tennessee. As such, you are likely to encounter wildlife (deer, bears, raccoons, snakes, and bugs of various types, including wasps and/or hornets, etc…). The owners of the cabins will not accept responsibility for any injury caused by said wildlife.
13. Swimming and Wading: Swimming and/or wading in the fish pond or creek is done so at your own risk. No life guards are provided. Owners do not accept responsibility for injury or accident while swimming or wading.
14. Hold Harmless: Guest(s) acknowledge and understand that each and every guest, or guardian, is solely responsible for any accident or injury to any person while in-residence, and the owners do not accept any legal or financial responsibility. Guests, and guardians, assume all risk of injury or other loss resulting from any recreational activity and will hold the owner harmless with respect thereto. Guest(s) hereby agrees to indemnify and hold Black Pine cabin rental owners harmless from any and all claims, including those of third parties, arising out of or in any way a result of the guest use of the premises or items therein.
15. Loss of personal items: Guest(s) acknowledge and understand that each guest, or guardian, is solely responsible for any loss by any person while in residence including the loss of money, jewelry or any other personal item.
16. Hot Tub use: The Hot tubs are primarily for adults. Children should not be allowed to use the hot tub as a swimming pool such as getting in and out of the tub to run around the yard. This contaminates the water and brings sand into the tub that can damage the pumps. Bathing suits that have been used to swim in the creek or pond should be washed out before use in hot tub to prevent growth of bacteria and alga. Children should not be allowed to splash water from the tub. If the water level drops below a certain point it will damage the pumps. The cover should not be left off of the tub while not in use. This will cause the heater and pump to run continuously and result in damage to the tub and excessive use of electricity. Guest(s) understand and agree that they are responsible for any and all damage done to the hot tub either by them or their guest(s) while in-residence. If hot tub is left in poor condition owner reserves the right to levy a $75.00 cleaning charge to be deducted from the security deposit.
17. Gas Fireplace: The fireplace inside this property is equipped with propane gas logs which must not be disturbed. Guest(s) agree that under no circumstances will no member of the party de-install the logs, rearrange the logs or burn anything other than the propane provided in the interior fireplace. To do so may cause damage to the logs and may also allow poisonous carbon monoxide to leak into the cabin which could prove harmful to your party or future guests. This is a safety issue- Any evidence of tampering will result in the loss of your deposit.
18. Black Pine Cabin Rental cannot be held responsible for the failing of any other company due to said company’s error or service interruption. (i.e. electricity etc..) However, we guarantee that we will due all that is possible to remedy any issue in the shortest time possible.
19. Cancellation Policy: Cancellations made 30 or more days prior to arrival will result in a full refund of the rental deposit less a service fee of $25.00. Cancellations made with less than 30 days notice, but at least 14 days prior to arrival date will result in the forfeiture of one half of the rental deposit. Cancellations made less than 14 days notice, but at least 7 days prior to arrival date will result in the full forfeiture of the rental deposit.
